In the event of damage to the rented vehicle, the renter is liable for repair costs actually incurred or determined by an expert’s report, recovery and repatriation costs, expert fees, technical depreciation, loss of rental income during the repair period or, in the case of a total loss, for the replacement period; in the event of theft, for the replacement value. <\/p>\n
A daily fee must be reimbursed for loss of rental income per day. The renter reserves the right to prove a lesser damage. The renter may only allow the vehicle to be driven by the authorized driver(s). In the event of damage, the renter is jointly and severally liable. Furthermore, it is recommended that vehicles only be operated within a 30 km radius, as our home service can quickly be on site within this radius and react quickly should problems arise. <\/p>\n
The use of the rented machines off-road or on cross-country or race tracks must be reported to the lessor in advance and approved by them in writing. The renter is also not permitted to use the vehicle for towing other vehicles, loads, or trailers.<\/p>\n
Obligations and Liability of the Lessor<\/span><\/h3>\nThe lessor hands over the vehicle in perfect, operational, and roadworthy condition. The lessor provides the renter with a copy of the vehicle registration document. The seals of individual components are unbroken. The lessor only recognizes prior damage if it was recorded in writing in the rental agreement upon handover. If a repair becomes necessary during the rental period through no fault of the renter to ensure the road safety or operation of the vehicle, the renter may commission an authorized specialist workshop for a repair amount up to \u20ac50.00. The original receipts must be submitted to the lessor. Should the repair amount exceed \u20ac50.00, the lessor’s approval must be obtained before placing the order. <\/p>\n
Rental Deposit \/ Security Deposit<\/span><\/h3>\nThe lessor requires a rental deposit\/security deposit of \u20ac100.00 from the renter upon handover, which will be returned to the renter after the rented item has been returned in accordance with the contract. Vehicles are also only rented to persons aged 23 and over. <\/p>\n
If the return time is exceeded by more than one hour, the renter is obliged to pay an additional daily rental fee per day as compensation. The renter reserves the right to prove that the lessor incurred no damage or significantly less damage from exceeding the rental period. If the vehicle is returned before the agreed end of the contract, there is no claim for partial reimbursement of the rental price. The right to extraordinary termination of the rental agreement is excluded. Helmet requirement: For their own safety, the renter undertakes to operate the vehicle only with a helmet permitted by road traffic regulations. The same applies to passengers. Helmets can also be rented from the lessor. <\/p>\n
Rental Price<\/span><\/h3>\nThe full rental price is to be paid in advance upon collection of the vehicle.<\/p>\n
Special Obligations of the Renter<\/span><\/h3>\nIn the event of an accident, theft, or fire, the lessor must be notified immediately. A detailed written report of the accident must be submitted to the lessor within 2 days. In all cases, including accidents without third-party involvement or with wildlife, the police must be notified immediately. The renter must insist that the accident, theft, or fire be officially recorded by the police. In the case of accident participants, the renter is obliged to record the names of all persons involved in the accident, witnesses, vehicle license plates, as well as the names and file numbers of the police officers present and the police station, and to hand them over to the lessor. Statements regarding fault may not be made to third parties. <\/p>\n
Abroad<\/span><\/h3>\nThe vehicle may not be used for cross-border traffic.<\/p>\n
Insurance<\/span><\/h3>\nThe vehicle is covered by liability insurance. Partial or comprehensive insurance with an excess can be taken out externally. We do not issue partial or comprehensive insurance policies. In the event of damage, the renter is liable only up to the amount of the excess and in accordance with the terms of the insurance company. If no partial or comprehensive insurance is taken out, the renter is solely liable for the entire damage in the event of damage, as well as for the loss of rental income for the lessor. <\/p>\n
In the event that the vehicle is not in contractual condition upon return, the lessor is entitled to use the rental deposit to restore the motorcycle, ATV, or scooter to a contractual return condition. No prior approval from the renter is required for this. The renter will receive an invoice for the used rental deposit. The unused rental deposit\/security deposit will be paid out to the renter after the vehicle has been repaired. The renter has been informed by the lessor that the screw for throttling the vehicle is sealed and that if it is removed by the renter or a passenger, there will be no insurance coverage. The full rental price is to be paid in advance upon collection of the vehicle.<\/p>\n
Special Obligations of the Renter<\/span><\/h3>\nIn the event of an accident, theft, or fire, the lessor must be notified immediately. A detailed written report of the accident must be submitted to the lessor within 2 days. In all cases, including accidents without third-party involvement or with wildlife, the police must be notified immediately. The renter must insist that the accident, theft, or fire be officially recorded by the police. In the case of accident participants, the renter is obliged to record the names of all persons involved in the accident, witnesses, vehicle license plates, as well as the names and file numbers of the police officers present and the police station, and to hand them over to the lessor. Statements regarding fault may not be made to third parties. <\/p>\n
Abroad<\/span><\/h3>\nThe vehicle may not be used for cross-border traffic.<\/p>\n
Insurance<\/span><\/h3>\nThe vehicle is covered by liability insurance. Partial or comprehensive insurance with an excess can be taken out externally. We do not issue partial or comprehensive insurance policies. In the event of damage, the renter is liable only up to the amount of the excess and in accordance with the terms of the insurance company. If no partial or comprehensive insurance is taken out, the renter is solely liable for the entire damage in the event of damage, as well as for the loss of rental income for the lessor. <\/p>\n
In the event that the vehicle is not in contractual condition upon return, the lessor is entitled to use the rental deposit to restore the motorcycle, ATV, or scooter to a contractual return condition. No prior approval from the renter is required for this. The renter will receive an invoice for the used rental deposit. The unused rental deposit\/security deposit will be paid out to the renter after the vehicle has been repaired. Failure to hand over the vehicle, keys, or vehicle documents on time at the agreed return location obliges the renter to compensate the lessor for any damage incurred.<\/p>\n
The renter has been informed by the lessor that the screw for throttling the vehicle is sealed and that if it is removed by the renter or a passenger, there will be no insurance coverage. If the lessor determines that the seal has been damaged or removed, an inspection of the vehicle will be carried out at the renter’s expense.<\/p>\n
